CANADA’S ANTI-SPAM LEGISLATION (CASL) COMPLIANCE
1. Commercial Electronic Messages
Western Maritime Institute complies fully with Canada’s Anti-Spam Legislation (CASL), S.C. 2010, c. 23. CASL regulates the sending of commercial electronic messages (CEMs), including marketing emails, newsletters, and promotional communications.
2. Express Consent
We will only send commercial electronic messages to individuals who have provided express written consent to receive communications from us. 5. Types of Electronic Messages
Western Maritime Institute sends various types of electronic messages to its users and customers:
Marketing and Promotional Messages (sent only with express consent):
- Marketing and promotional emails regarding our courses, programs, and services
- Course announcements and schedule updates
- Educational newsletters and industry updates
- Event invitations and promotional offers
- Product updates and service announcements
Transactional and Operational Messages: Course confirmations, account notifications, student portal updates, customer service responses, and account management messages are considered transactional communications. All transactional messages will include clear identification of Western Maritime Institute as the sender and contact information, consistent with CASL requirements.
6. Personal Information and Privacy
We collect and process email addresses and personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and our Privacy Policy. All personal information used for sending electronic messages will be handled securely and will not be shared with third parties except as necessary for service delivery. 7. Third-Party Service Providers
Western Maritime Institute may engage third-party service providers, email service providers, and marketing platforms to assist in sending electronic messages. We remain fully responsible for ensuring CASL compliance in all communications sent on our behalf.
TERMINATION
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
GOVERNING LAW
These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
